June

  • 1st: Request sent to obtain the detailed listing of the posted percentage cuts by service provider that was temporarily on the website when the notice was issued to service providers and the general public of impending cuts without agreement. This request references when suring the 2011 special legislative session, a notice was put out stating that payments to Medicaid providers would be reduced if the Legislature did not reach an agreement on Medicaid funding. The website provided a detailed listing of the percentage cuts by each provider service. These cuts would reportedly have lasted from April 1, 2001 to July 1, 2011.

  • 1st: Request sent to obtain the proposal that was provided to the Kentucky Cabinet for Health and Family Services by University Health Care, Inc. (Passport Health Plan) for Fiscal Year 2011 services including all exhibits, appendices, attachments, and other associated documentation that was part of the negotiation basis for the contract negotiated with University Health Care, Inc.

March

  • 28th: received a letter dated March 24, 2011 denying both requests sent on the 18th.
  • 18th: two requests sent to obtain:
    • 1:detailed research, surveys, investigations, presentations, and analysis on the anticipated impact of implementing stated reductions of approximately 35 percent would have on: a. Hospitals, nursing facilities, home health agencies, community-based services, pharmacies, comprehensive care centers, primary care centers, local health departments and other providers of Medicaid services in the Commonwealth b. Recipients of Medicaid services throughout the state

    • 2: Detailed research, surveys, investigations, presentations, and analysis that resulted in the conclusion that the Cabinet must significantly reduce payment for specified services for hospitals, nursing facilities, home health agencies, community-based services, pharmacies, comprehensive care centers, primary care centers, local health departments and other providers of Medicaid services in the Commonwealth. The public notice stated the rate reductions will be approximately 35 percent and are necessary to balance the Fiscal Year 2011 budget shortfall in the Medicaid program.

  • 5th: Three requests were sent...
  • 11th: received an email stating that the cabinet was in receipt of all three records requests and that it was "diligently reviewing its records to ascertain if any nonexempt records responsive to your request exist, as these records are in active use, storage, or are otherwise unavailable at this time." The cabinet projected that the records would be available to view by April 10, 2011.
    • 1 - A request was sent to obtain a detailed accounting and listing of all savings and efficiencies that have been realized in the Medicaid

program for the past 15 months ending March 1, 2011 as could be verified by independent audit.

June

  • 25th: A request was submitted to the Kentucky Cabinet for Health and Family Services, to obtain the following -
    • 1: All budgetary guidance put out to the agencies and staff within the cabinet for the budget submitted to be consolidated into the budget the Governor provided for the Kentucky General Assembly session that ended April 15, 2010.
    • 2: All budgetary guidance put out to agencies and staff within the cabinet for any modified budget submitted for consolidation into the budget the Governor provided for the Kentucky General Assembly special session beginning May 24, 2010.
    • 3: All goals and proposed metrics established for agencies and staff for the budget that was prepared and submitted for consolidation into the budget the Governor provided for the Kentucky General Assembly session that ended April 15, 2010.
    • 4: All internal recommendations from the secretary, the agencies and staff for consideration and decision for any modified budget submitted for consolidation into the budget the Governor provided for the Kentucky General Assembly special session beginning May 24, 2010.
    • 5: All recommendations proactively provided by the secretary, the agencies and staff for cutting the budget by reductions in staffing, restructuring, improving processes, consolidations of programs, elimination of programs, outsourcing work or similar actions making your cabinet more ‘effective’ and/or more ‘cost effective’ during the latest general and special session budget cycles.
    • 6: All analysis, risk assessments and impact assessments prepared by the secretary, the agencies agencies, staff and consultants on cutting cabinet budget in any area of concern to the secretary.
    • 7: All performance improvements, improving operational effectiveness and cost effectiveness commitments made by the secretary, the agencies and staff for the performance period covered by the budget passed in Kentucky General Assembly special session beginning May 24, 2010.
  • 29th: received a letter stating that the request had been received and tha the documents were being gathered. The letter also advised that pre-payment for the copies of the documents would be expected.

July

  • 19th: received a letter stating that the request had been DENIED. The following reason was given"

The request is denied pursuant to KRS 61.878(1)(i) & (j). The documents are either preliminary drafts, notes, and recommendations, and/or preliminary memoranda in which opinions are expressed or policies formulated or recommended. See 10-ORD-103 which states that "while records exchanged by city employees in the formulation of the proposed budget, and consisting of notes, drafts, recommendations, and memoranda in which opinions are expressed, fall within the parameters of KRS 61.878(1)(i) & (j), the proposed budget that results from the intra- or inter-agency exchange or opinions and ideas, reflected in those preliminary documents, represents final action of the Mayor, who is himself a public agency pursuant to KRS 61.870(1)(a)."
