Kentucky Lighter Ban

In 2009, the Kentucky House of Representatives decided to pursue the banning of 'novelty lighters'. The proposed ban was proposed by Rep. Derrick Graham (D-Frankfort) and was supported by all but one member of the Kentucky House of Representatives[1].

The Proposed Law
The ban effectively makes the sale of novelty lighters illegal. A novelty lighter is defined as mechanical or electrical devices typically used for lighting cigarettes, cigars, or pipes that is designed to appear to be a toy, feature a flashing light, or make musical sounds.
A "novelty lighter" does not include:
- A lighter manufactured prior to January 1, 1980;
- A lighter incapable of being fueled or lacking a device necessary to produce combustion or a flame; or
- Any mechanical or electrical device primarily used to ignite fuel for fireplaces or for charcoal or gas grills[2].
